Arthritis Foundation Awaits Decision in Braidwood Management, Inc. et al. v.Xavier Becerra et al.

Millions Have Benefited from No Cost Preventive Care; Barriers Would Lead to Worse Health Outcomes

ATLANTA, GA – March 7, 2024 – On March 4, the U.S. Court of Appeals for the Fifth Circuit heard oral arguments in Braidwood Management v. Becerra, a case that threatens access to evidence-based preventive services without cost-sharing as required under the Affordable Care Act (ACA). The services at-risk include those recommended by scientific experts at the U.S. Preventive Services Task Force (USPSTF), the Advisory Committee on Immunization Practices (ACIP) and the Health Resources and Services Administration (HRSA).

The Arthritis Foundation and other national health groups (listed below) filed an amicus brief citing research showing how cost-sharing decreases patients’ ability to receive care that can prevent disease, identify illness early and reduce the physical and financial burden of severe illnesses. The groups issued urge the court to maintain access to life-saving no cost preventive care.

The services at issue include proven screenings for breast, colorectal, cervical, and lung cancers, as well as cholesterol testing for cardiovascular conditions, and other services, all of which are important to the millions of adults and children with doctor-diagnosed arthritis.

Echoing statements made in the amicus brief, the Arthritis Foundation urges the court to understand the consequences of the district court’s decision regarding these coverage requirements.
