THESE OFFICIAL RULES AFFECT YOUR LEGAL RIGHTS BY REQUIRING MANDATORY ARBITRATION, WAIVING CLASS ACTION CLAIMS AND WAIVING THE RIGHT TO TRIAL BY JURY.
The Arthritis Foundation Sweepstakes ("Sweepstakes") is sponsored by Arthritis Foundation, 1355 Peachtree St. NE, Suite 600, Atlanta, GA 30309 ("Sponsor"). Sweepstakes is governed by these official rules ("Official Rules"). By participating, entrant agrees to abide by these Official Rules and understands that the results of the Sweepstakes, as determined by Sponsor, are final in all respects. Sweepstakes is subject to all federal, state and local laws and regulations and is void where prohibited by law.
ODDS OF WINNING. Odds of winning a prize depend on number of eligible entries received.
ELIGIBILITY. Sweepstakes is open to legal residents of fifty (50) U.S. States and District of Columbia, twenty-one (21) years of age and older and who have Internet access and valid e-mail at time of entry.
Employees, officers and directors of Sponsor and its affiliates, subsidiaries, franchisees, agents, associates, dealers, representatives, suppliers, and advertising and promotional agencies ("Sweepstakes Parties"), as well as members of their immediate families (defined as parents, spouses, children, siblings and grandparents) and individuals living in the same household as those individuals are not eligible to enter or win. Sponsor reserves the right to verify the eligibility of each entrant.
SWEEPSTAKES PERIOD. Sweepstakes begins at 12:01am Eastern Time ("ET") on February 6, 2017 and ends at 11:59 pm ET on February 13, 2017 ("Sweepstakes Period").
HOW TO ENTER.
There are two ways to enter:
(1) Enter Online: All eligible individuals who make a donation to The Arthritis Foundation through the Arthritis Foundation website (located at http://www.arthritis.org/GoMattGo/ during the Sweepstakes Period will automatically receive one (1) entry into the Sweepstakes. A minimum donation of $10 is required to enter online. Note – donations made to other Arthritis Foundation pages or at any other events during the Sweepstakes Period will not be considered a sweepstakes entry. Entry is limited to donations made only through http://www.arthritis.org/GoMattGo/ and/or via mail in entry (no donation required) described below.
(2) Enter by Mail: To enter by mail, hand-print your first and last name, mailing address, phone number, e-mail address and the words "Arthritis Foundation Sweepstakes" on a 3" x 5" card and mail it in a #10 envelope (with postage) to: Arthritis Foundation, ATTN: Marketing Department, 1355 Peachtree St. Ne, Suite 600, Atlanta, GA 30309. Mail-in entries must be postmarked on or before February 13, 2017 and received by February 16, 2017 to be eligible for the prize drawing. Only fully completed entries will be valid. Failure to provide the information specified in this paragraph will result in an entry being disqualified. All submissions become the property of the Sponsor and will not be returned.
Limit one (1) entry per person, regardless of the method of entry.
Sponsor is not responsible for lost, late, stolen, misdirected, mutilated, incomplete, damaged, or postage due entries. No telephoned, faxed, or mechanically reproduced entries will be accepted. Receipt of entries will not be acknowledged nor will proof of submission of an entry be deemed proof of receipt. Sponsor has no obligation to advise an entrant of an incomplete or otherwise non-compliant entry. Use of automated entry systems and tampering with the entry process or the operation of the Sweepstakes is prohibited and any entries deemed by Sponsor, in its sole discretion, to have been submitted in this manner will be void. Entries generated by a script, macro, or other automated means will be disqualified.
In the event of a dispute as to any entry, the authorized account holder of the e-mail account used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. Potential winner may be required to show proof of being the authorized account holder.
One (1) potential Grand Prize winner will be randomly selected on or about February 28, 2017 ("Grand Prize Drawing Date") from all eligible entries received.
Potential prize winner will be notified by phone or email according to the contact information provided by that entrant up to three (3) times within seven (7) days after the prize drawing. Please ensure email settings are set up to allow for receipt of email from Sponsor. Sponsor assumes no responsibility for undeliverable prize notification resulting from any form of active or passive filtering by entrant’s email settings or for insufficient space in an entrant’s user account to receive email notification.
Potential prize winner must sign and return any required forms, including, without limitation, affidavit of eligibility, prize acceptance and liability and publicity release form and IRS-W9 forms ("Sweepstakes Forms") to Sponsor within seven (7) days after delivery of the forms. Return of the above-mentioned Sweepstakes Forms within the allotted time is the sole responsibility of the prize winner; Sponsor is not responsible for delays in delivery. If prize notification is returned as undeliverable or if a potential prize winner fails to comply with these Official Rules, cannot be reached by Sponsor, or fails to return the Sweepstakes Forms within the time specified, that potential prize winner will not be deemed a winner and disqualified and a new potential winner selected from among all remaining eligible entries, time permitting.
Prize may not be awarded if an insufficient number of eligible entries is received. Sponsor shall not be required to award more than the stated number of prizes.
One (1) Grand Prize – Prize is one (1) ocean view cabin for one (1) winner and one (1) travel guest (double occupancy accommodations) on a 3, 4, or 7-day cruise onboard either a Carnival Cruise Line, Princess Cruises or Holland America Line cruise ship departing from and return to a United States port. Prize consists of cruise fare only. Winner and travel guest are responsible for transportation to and from the port of departure and arrival. All expenses and incidental costs not expressly stated herein, including, but not limited to, ground transportation, meals, incidentals, port expenses, gratuities, passenger tariffs or duties, airfare, airline fees, surcharges, airport fees, service charges or facility charges, pre and post-voyage accommodations, personal charges at lodging, fees, taxes, travel insurance, bag check fees, port expenses, onboard expenses, premium dining, spa treatments, specialty restaurant fees, laundry service, alcoholic beverages (including mini-bar) and soft drinks, shore excursions, incidental costs, phone charges, merchandise, souvenirs and other expenses are the responsibility solely of winner and travel guest. (Approximate Retail Value ("ARV") of Grand Prize: $2,500).
Terms Applicable Cruise Prize Described above: The prize does not include transportation for winner and guest to/from the cruise port of call selected by each winner and winner’s home. Winner is solely responsible for all costs and expenses associated with transportation to/from the port of call for both winner and guest. Travel guest must (or travel guest’s parent or legal guardian if a travel guest is an eligible minor in his/her state/province of residence) sign and return a travel/publicity release before any ticketing of travel occurs. Winner and travel guest must: (i) have all necessary identification and/or travel documents (including, but not limited to, a valid passport or other document) required for travel; and (ii) comply with all check-in requirements, including, but not limited to, the presentation of identification and a major credit card. No cash redemptions. Travel guest must travel on the same itinerary as cruise prize winner. Any portion of the cruise prize not accepted by a winner will be forfeited, and Sponsor shall not be responsible for any inability of a winner to accept or use any portion of the cruise prize for any reason. Sponsor does not guarantee the cruise prize will be available on the exact sailing dates requested by a winner. Other limitations and restrictions may apply. Date confirmation is subject to stateroom availability and other factors. Cruise prize may not be sold or combined with any other offer. Cruise prize winner must notify Sponsor (or its designee) of desired dates of travel pursuant to these Official Rules, by no later than thirty (30) days prior to the date of departure of the desired cruise sailing. No changes will be made to travel details once any element(s) of the travel arrangements have been booked, except at Sponsor’s sole discretion. Any cancellations of the sailing will result in forfeiture of the cruise prize. No "Vacation Guarantee" or similar type offer shall apply to the cruise prize. Cruise prize is subject to the terms and conditions set forth in these Official Rules and those set forth and detailed in cruise line’s passenger ticket contract (for Carnival Cruise Line found here: http://www.carnival.com/about-carnival/legal-notice/ticket-contract.aspx, for Princess Cruises found here: http://www.princess.com/legal/passage_contract/pcl.html and for Holland America Line found here: https://www.hollandamerica.com/legalAndPrivacy/Main.action). No stateroom upgrades or downgrades shall be permitted. No refund, credit, or compensation will be made in the event of the cancellation or delay of any flight or ground transportation. Infants accompanying an adult on the cruise must be at least six (6) months of age. At least one individual on the cruise must be twenty-one (21) years of age. Cruise is subject to all carrier restrictions, requirements, rules, regulations, policies, service charges, blackout dates, advance ticketing requirements, capacity controls, availability and other restrictions. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. Travel is subject to capacity controls, availability, blackout dates and certain other restrictions, all of which are subject to change. Unclaimed prize will be forfeited. If a winner does not accept or use the entire prize, the unaccepted or unused part of the prize will be forfeited and Sponsor will have no further obligation with respect to that prize or portion of the prize. Winner is strictly prohibited from selling, auctioning, trading or otherwise transferring any part of the prize. In the event a winner and/or his or her travel guest engage in behavior that (as determined by Sponsor in its sole discretion) is obnoxious or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to terminate the trip or other applicable experience early, in whole or in part, and send winner and/or his or her travel guests home with no further compensation. Unused components of the prize have no redeemable cash value.
Prize is non-transferable. Sponsor reserves the right to substitute any prize for one of equal or greater value. Winner may not request prize substitution. If potential winner accepts the prize, but is unable to travel on dates specified by Sponsor, the prize may be forfeited and Sponsor may select a new winner (time permitted) or offer a different prize to potential winner, in Sponsor’s sole discretion. Any difference between the ARV and actual value will not be awarded.
All prize details not specified in these Official Rules will be determined in Sponsor’s sole and absolute discretion. Prize is awarded "AS IS" and without warranty of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). Prize winner will be solely responsible for all federal, state and/or local taxes, and for any other fees or costs associated with the prizes they receive, regardless of whether they, in whole or in part, are used. The ARV of the prizes is based on available information provided to Sponsor and the value of any prize awarded to a winner may be reported for tax purposes as required by law. The winner may be required to provide Sponsor with a valid social security number or tax identification number before the prizes will be awarded for tax reporting purposes. An IRS Form 1099 may be issued in the name of winner for the actual value of the prize received.
Sponsor and its respective parent, affiliate and subsidiary companies, agents, and representatives are not responsible for any typographical or other errors in the offer or administration of the Sweepstakes, including, but not limited to, errors in any printing or posting of these Official Rules, the selection and announcement of any winner, or the distribution of any prize. Any attempt to damage the content or operation of this Sweepstakes is unlawful and subject to possible legal action by Sponsor. Sponsor reserves the right to terminate, suspend or amend the Sweepstakes, without notice, and for any reason, including, without limitation, if Sponsor determines that the Sweepstakes cannot be conducted as planned or should a virus, bug, tampering or unauthorized intervention, technical failure or other cause beyond Sponsor’s control corrupt the administration, security, fairness, integrity or proper play of the Sweepstakes. In the event any tampering or unauthorized intervention may have occurred, Sponsor reserves the right to terminate the Sweepstakes and void suspect entries at issue. Sponsor and its respective parent, affiliate and subsidiary companies, agents, and representatives, and any telephone network or service providers, are not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network, computer equipment or software, the inability to access any website or online service or any other error, human or otherwise.
limitation of liability. BY ENTERING, EACH ENTRANT AGREES TO RELEASE AND HOLD HARMLESS THE SWEEPSTAKES PARTIES AND CARNIVAL CORPORATION FROM ANY LIABILITY, DAMAGES, LOSSES OR INJURY (INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES) WHETHER ARISING IN TORT (INCLUDING NEGLIGENCE, WHETHER ACTIVE, PASSIVE OR IMPUTED), CONTRACT, WARRANTY, STRICT LIABILITY, RELIANCE OR UNDER ANY OTHER THEORY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THAT ENTRANT'S PARTICIPATION IN THE SWEEPSTAKES AND/OR THE ACCEPTANCE, USE OR MISUSE OF ANY PRIZE THAT MAY BE WON, AND WHETHER OR NOT SPONSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
PRIVACY. Personal information collected from entrants is subject to Sponsor’s privacy statement available at //www.arthritis.org/about-us/privacy-policy.php - Sponsor may engage certain third party companies to perform services in connection with prize fulfillment and the administration of this Sweepstakes and information provided by entrants may be collected and used by those third parties for purposes of administration of the Sweepstakes and the fulfillment and verification of prize award.
Publicity. By participating, each participant grants Sponsor permission to use his/her name, likeness, or comments for publicity purposes without payment of additional consideration, except where prohibited by law.
DISPUTE RESOLUTION; NO CLASS RELIEF.
BY ENTERING THE SWEEPSTAKES, ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (A) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE SWEEPSTAKES, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (B) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED TEN DOLLARS ($10.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (C) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED TEN DOLLARS ($10.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (D) ENTRANTS’ REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.
The parties each agree to finally settle all disputes only through arbitration; provided, however, the Sponsor shall be entitled to seek injunctive or equitable relief in the state and federal courts in Fulton County, Georgia and any other court with jurisdiction over the parties. In arbitration, there is no judge or jury and review is limited. The arbitrator’s decision and award is final and binding, with limited exceptions, and judgment on the award may be entered in any court with jurisdiction. The parties agree that, except as set forth above, any claim, suit, action or proceeding arising out of or relating to this Sweepstakes shall be resolved solely by binding arbitration before a sole arbitrator under the streamlined Arbitration Rules Procedures of JAMS Inc. ("JAMS") or any successor to JAMS. In the event JAMS is unwilling or unable to set a hearing date within fourteen (14) days of the filing of a "Demand for Arbitration", then either party can elect to have the arbitration administered by the American Arbitration Association ("AAA") or any other mutually agreeable arbitration administration service. If an in-person hearing is required, then it will take place in Fulton County, Georgia. The federal or state law that applies to these Official Rules will also apply during the arbitration. Disputes will be arbitrated only on an individual basis and will not be consolidated with any other proceedings that involve any claims or controversy of another party, including any class actions; provided, however, if for any reason any court or arbitrator holds that this restriction is unconscionable or unenforceable, then the agreement to arbitrate doesn’t apply and the dispute must be brought in a court of competent jurisdiction in Fulton County, Georgia. Sponsor agrees to pay the administrative and arbitrator’s fees in order to conduct the arbitration (but specifically excluding any travel or other costs of entrant to attend the arbitration hearing). Either party may, notwithstanding this provision, bring qualifying claims in small claims court.
